These Terms & Conditions (“Terms”) govern your access to and use of Fashionistaway.com, purchases from Fashionistaway, and your use of services provided by Fashionistaway.
By accessing our website, placing an order, purchasing a product, requesting a service, or otherwise engaging with Fashionistaway, you agree to these Terms.

1. ACCEPTANCE OF THESE TERMS
By accessing Fashionistaway.com, purchasing products, requesting services, or otherwise using our website or authorised sales channels, you acknowledge that you have read, understood, and agreed to these Terms.
If you do not agree with these Terms, you should not use our Services or place an order with Fashionistaway.
2. ABOUT FASHIONISTAWAY
Fashionistaway is a Hong Kong-based retailer specialising in authenticated preloved luxury goods and professional luxury care and restoration services.
We offer a curated selection of luxury handbags, wallets, footwear, clothing, small leather goods, jewellery, accessories, and other luxury products from established fashion houses.
Fashionistaway also provides professional care and restoration services for luxury goods.
3. ELIGIBILITY
By placing an order or entering into a transaction with Fashionistaway, you confirm that you have the legal capacity to enter into a binding agreement under applicable law.
If you are purchasing on behalf of another person or organisation, you confirm that you are authorised to act on their behalf.
4. PRODUCTS & SERVICES
Fashionistaway specialises primarily in preloved luxury goods. Individual products are generally unique and available in a quantity of one unless otherwise stated.
We make reasonable efforts to provide accurate product descriptions, photographs, measurements, condition information, inclusions, and other relevant information.
Colours and appearance may vary slightly depending on lighting, photography, display settings, and the device used to view our website.
Availability is not guaranteed until an order or reservation has been confirmed by Fashionistaway.
5. PRELOVED PRODUCT CONDITION
Unless expressly identified as unused, products offered by Fashionistaway are preloved and may display signs of previous ownership consistent with their stated condition.
We inspect products before offering them for sale and disclose material condition information that we consider relevant to a purchasing decision.
Normal characteristics of preloved goods, including minor signs of use, ageing, storage, material variation, or previous ownership, do not by themselves constitute defects where they are consistent with the product's description and stated condition.
Customers should review the product description, condition information, photographs, measurements, and inclusions before purchasing.
6. AUTHENTICITY
Authenticity is a core standard of Fashionistaway.
Every luxury item offered for sale by Fashionistaway undergoes physical inspection and authentication by our experienced in-house authenticators before being approved for sale.
Fashionistaway does not rely on AI authentication devices or outsource authentication of the products we offer for sale. We believe thorough luxury authentication requires experienced human judgement and physical examination of the item, including relevant materials, construction, craftsmanship, hardware, markings, ageing characteristics, and other brand-specific details.
Fashionistaway is a participating retailer in the Federation of Hong Kong Industries' No Fakes Pledge Scheme and maintains a strict policy against counterfeit goods.
7. PRICING & CURRENCY
Product prices are displayed in the currencies available through Fashionistaway's applicable markets and sales channels.
Prices may change without notice, but a price change will not normally affect an order that has already been confirmed, except where an obvious pricing or technical error has occurred.
International customers may incur customs duties, import taxes, VAT, clearance fees, or other charges imposed by their destination country. Unless expressly stated otherwise, these charges are not included in Fashionistaway's prices and are the customer's responsibility.
8. ORDERS
Submitting an order does not necessarily constitute final acceptance of the transaction.
Fashionistaway may review orders for product availability, payment confirmation, suspected fraud, pricing errors, technical errors, or other legitimate business reasons before confirming fulfilment.
Because many Fashionistaway products are one-of-one, an item may become unavailable if it has already been purchased or reserved through another authorised Fashionistaway sales channel.
If Fashionistaway cannot fulfil an order after payment has been received, we will contact the customer and provide an appropriate remedy.
9. PAYMENT METHODS
Payment methods currently available for online purchases may include:

- Mastercard
- American Express
- UnionPay
- Apple Pay
- Google Pay
Available payment methods are displayed at checkout and may vary depending on the customer's location, currency, device, transaction, and payment-provider availability.
Online payments are processed securely through Shopify Payments and applicable payment-processing partners.
Fashionistaway does not ordinarily store complete customer payment-card information.
10. FASHIONISTAWAY INSTALLMENT / LAYAWAY PLAN
Fashionistaway offers an in-house installment / layaway arrangement for eligible purchases.
This arrangement is administered directly by Fashionistaway and is separate from the standard online checkout process.
10.1 Deposit
A 30% deposit is required to reserve an item under the Fashionistaway Installment / Layaway Plan.
Once the deposit has been received, the item will be reserved for the customer and removed from general availability.
The deposit is non-refundable to the extent permitted by applicable law, unless otherwise agreed by Fashionistaway or required by applicable consumer law.
10.2 Payment Term
The remaining balance must be fully paid on or before the agreed final due date. The maximum installment / layaway term is 3 months from the agreed start date.
Customers are not required to make equal monthly payments. Partial payments may be made at any time during the agreed payment period, provided that the entire outstanding balance is paid on or before the agreed final due date.
10.3 Fees & Early Settlement
Payments are payable on or before the agreed due date with no extra fee.
Customers may settle the remaining balance early at any time. Fashionistaway does not charge an early-settlement fee.
10.4 Shipment or Collection
Products purchased under an installment / layaway arrangement will be released for shipment or showroom collection only after the full outstanding balance and any applicable shipping charges have been paid.
10.5 Cancellation & Missed Final Payment
If the customer wishes to cancel an installment / layaway arrangement, or fails to complete payment by the agreed final due date, Fashionistaway may cancel the arrangement and return the item to available inventory.
Any treatment of the deposit or other payments will be subject to the agreed installment / layaway terms and applicable law.
11. SHIPPING & DELIVERY
Fashionistaway ships from Hong Kong to Hong Kong and selected international destinations.
Hong Kong delivery is free with no minimum purchase required.
Hong Kong orders are generally shipped via SF Express.
International shipping rates, free-shipping thresholds, and available destinations are displayed through our Shipping Policy and checkout.
Please allow up to 3 business days for order processing after payment has been successfully completed.
Estimated international delivery is generally 7–14 business days after dispatch.
Delivery times are estimates and may be affected by customs clearance, courier operations, weather, public holidays, transportation disruptions, or circumstances outside Fashionistaway's reasonable control.
International customers are responsible for applicable customs duties, import taxes, clearance charges, and other fees imposed by their destination country unless otherwise stated.
12. RETURNS, EXCHANGES & STORE CREDIT
Eligible purchases may be returned within 14 days of receiving the order, subject to Fashionistaway's Returns, Exchanges & Store Credit Policy.
For ordinary change-of-mind returns, Fashionistaway provides eligible customers with an exchange or store credit rather than a cash refund.
Original shipping charges and return shipping costs are not refundable for ordinary change-of-mind returns.
Returned products must satisfy the eligibility requirements stated in our Returns, Exchanges & Store Credit Policy.
Where an item is incorrect, materially misdescribed, damaged in transit, or otherwise subject to rights or remedies under applicable consumer law, Fashionistaway will handle the matter in accordance with applicable legal requirements.
Nothing in these Terms limits any consumer right or remedy that cannot lawfully be excluded.
13. LUXURY CARE & RESTORATION SERVICES
Fashionistaway provides professional care and restoration services for luxury goods.
Services may include cleaning, leather colour restoration, recolouring, hardware replating, repairs, restoration, preservation, and other appropriate treatments depending on the item and its condition.
Each item is assessed individually before services are recommended or performed.
Restoration outcomes may vary depending on the item's material, age, construction, previous treatments, existing damage, condition, and other characteristics.
Fashionistaway will use reasonable professional care when performing approved services but cannot guarantee that all signs of wear, damage, ageing, staining, colour loss, or previous alteration can be completely removed.
14. INTELLECTUAL PROPERTY
Unless otherwise stated, the content of Fashionistaway.com, including text, photographs, graphics, logos, branding, page designs, videos, product presentation, and original content, belongs to Fashionistaway or is used with appropriate permission.
Fashionistaway content may not be copied, reproduced, republished, distributed, modified, commercially exploited, or used to misrepresent an association with Fashionistaway without prior written permission, except where permitted by applicable law.
Third-party trademarks, brand names, logos, and product names remain the property of their respective owners.
15. ACCEPTABLE USE
You must not use Fashionistaway.com or our Services for unlawful, fraudulent, abusive, misleading, or harmful purposes.
You must not attempt to interfere with the security, operation, integrity, or availability of our Website or Services.
You must not use Fashionistaway's content, customer information, systems, or Services in a manner that infringes the rights of Fashionistaway or any third party.
16. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Fashionistaway will not be liable for indirect, incidental, special, consequential, or purely economic losses arising from use of our Website, products, or Services where such liability may lawfully be limited.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
17. INDEMNITY
To the extent permitted by applicable law, you agree to be responsible for losses, liabilities, claims, or expenses reasonably arising from your unlawful misuse of Fashionistaway's Website or Services, violation of these Terms, or infringement of another person's rights.
18. FORCE MAJEURE
Fashionistaway will not be responsible for delays or failure to perform obligations caused by circumstances outside our reasonable control, including natural disasters, severe weather, government restrictions, transportation interruptions, customs delays, courier disruptions, telecommunications failures, labour disruptions, or other comparable events.
19. GOVERNING LAW
These Terms are governed by the laws of the Hong Kong Special Administrative Region, subject to any mandatory consumer-protection rights that may apply to a customer in another jurisdiction.
Disputes will be subject to the jurisdiction of the courts of Hong Kong unless applicable law requires otherwise.
20. CHANGES TO THESE TERMS
Fashionistaway may update these Terms periodically to reflect changes to our business, Services, policies, technology, or applicable legal requirements.
The updated version will be published on Fashionistaway.com with the applicable revision date.

These Terms should be read together with other Fashionistaway policies published on our Website, including:

22. ENTIRE AGREEMENT
These Terms, together with applicable Fashionistaway policies and any specific terms agreed in connection with an order or service, constitute the agreement between Fashionistaway and the customer regarding the relevant transaction or use of our Services.
